Welcome to Kodiak, a restricted-access software distributed under conditions. By accessing Kodiak, you agree to these Terms of Service. This document is legally binding and governs your use of the software. Failure to comply may result in immediate, permanent, and non-contestable suspension of your access, without refund or prior warning.

1. Nature of the Software

Kodiak is a client behavior modification tool that automates or alters certain in-game actions (e.g., PvP, movement, environment interaction, etc.). By nature, Kodiak may violate server rules or terms of service of third-party platforms.

The user assumes full responsibility for how they use the software.

2. License of Use

Each copy of Kodiak is issued through a unique, personal, non-transferable license that may be revoked at any time by the administrators or developers.

The license grants you:

• Limited usage rights
• Monitored access to protected software
• Conditional tolerance based on your global behavior

It does not grant you ownership, reverse engineering rights, modification rights, public distribution, or any form of public exploitation.

3. Behavior Clause and License Revocation

Your access to Kodiak may be revoked, temporarily or permanently, in the following cases (non-exhaustive list):

Disrespectful or toxic behavior:

• Provocation, insults, defamation towards team members or the community
• Immature, demanding, aggressive, or destructive behavior in tickets or private messages
• Any attitude considered harmful to the project’s reputation

Improper or abusive use of the software:

• Use in unauthorized games or projects
• Use with the intent to harm individuals (stream sniping, harassment, etc.)
• Unauthorized modification or patching of Kodiak’s behavior

Breach of confidentiality or integrity:

• Public or private sharing of your key/license
• Binary analysis, injection, or dumping
• Sharing internal information without permission

Technical circumvention:

• Using spoofers, VPNs, sandboxes, VMs, or other masking techniques
• Using the software from unauthorized multiple devices

Leak, resale, or public exposure:

• Any leak of content (keys, files, screenshots, UI, debug) will result in:
• Permanent blacklist (public or private)
• Immediate revocation of all access
• Report to associated projects or partners

License removal can be applied without warning, justification, or discussion. By accepting these terms, you acknowledge that you are not entitled to any appeal or refund if penalized.

4. Confidentiality & Security

Kodiak uses a security system based on:

• Machine environment analysis (HWID, disk, hostname)
• Session tracking (IP, playtime, usage flags)
• Periodic behavior checks

No personal data is collected unless voluntarily provided. Any attempt to obfuscate or tamper with this system will be considered fraud.

5. Penalties

• Temporary or permanent kick
• Blacklist across all Kodiak-related services
• Public mention (nickname, hash) in Discord or other channels
• Ban from affiliated or partner projects

The team reserves the right to publish or share evidence of malicious behavior.

6. Project Development

Kodiak may be modified, paused, or restricted at any time. Access may be limited or conditioned depending on needs. No guarantee is provided regarding availability, update frequency, or compatibility with the latest game versions.

7. User Responsibility

By using Kodiak, you agree to the following risks:

• Being banned from third-party servers
• Loss or corruption of your data
• Malfunction of your game

The Kodiak developer shall not be held liable under any circumstance.

8. Law and Jurisdiction

These terms are governed by the laws of the developer’s country. Any dispute shall be resolved under competent local jurisdiction.

9. Acceptance

By downloading, installing, or using Kodiak, you acknowledge having read, understood, and accepted all these terms. Any attempt to circumvent them will result in immediate exclusion.
